Scope of Practice

Nature of Practice

Weston Intelligence Forensics LLC d/b/a Weston Intelligence provides forensic audit and consulting services relating to surveillance evidence in claims litigation.

The Weston Sub Rosa Audit™ is an independent operational forensic review of surveillance packages produced in litigation or claim-related discovery. The audit evaluates whether a surveillance package appears reliable, complete, lawfully obtained, accurately reported, and sufficiently documented to withstand adversarial scrutiny.

Intended Retention Structure

Engagements are structured for retention by counsel as non-testifying consulting work product under Federal Rule of Civil Procedure 26(b)(4)(D) and applicable state-law equivalents.

Substantive review begins after the engagement letter is executed.

What the Audit Reviews

Depending on scope, The Weston Sub Rosa Audit™ may review surveillance video, written surveillance reports, photographs, billing records, tasking materials, metadata and file information where available, chain-of-custody documentation, investigator disclosures, licensing and jurisdictional indicators, OSINT and background materials provided by counsel, discovery records, and production context.

Public Dimensions, Private Methods

The audit is organized around public review dimensions. The diagnostic protocols, verification methods, analytical weighting, review sequence, internal reference materials, and operational workflows remain proprietary.

The dimensions are public. The methods are not.

What the Audit Does Not Provide

Unless separately agreed in writing, Weston Intelligence does not provide legal advice, legal conclusions, trial strategy, disclosed expert testimony, deposition testimony, trial testimony, independent field surveillance, claimant interviews, defense witness interviews, frame-level video forensics, AI-manipulation authentication, Daubert-qualified testifying expert work, medical causation analysis, damages analysis, or final determinations of admissibility, sanctions, fraud, bad faith, criminal conduct, or state of mind.

Counsel Controls Legal Use

Findings, reliability observations, witness questions, document targets, and discovery issues are provided for retaining counsel’s consideration. Counsel determines legal sufficiency, motion strategy, discovery scope, admissibility arguments, deposition use, settlement impact, and trial deployment.

Confidential Methods Notice

Analytical methods, proprietary review protocols, internal reference materials, and operational workflows are not transferred with deliverables and remain protected work product of Weston Intelligence.

Distribution Restriction

Reports, mockups, private presentations, engagement materials, examination architecture, and discovery architecture are confidential unless expressly stated otherwise in writing. They may not be distributed, published, used for internal training, shared with non-retaining parties, or used to build derivative methods without written permission.
